Burglary is an offense against possession and habitation. A component of the offense is trespass - the act of entering a building or occupied dwelling without the consent of the victim. This includes gaining entry by tricking the victim.
In a burglary, a trespasser enters a building with the intent to steal, damage, commit vandalism or inflict bodily harm. It can be prosecuted as a felony or gross misdemeanor. An individual may be guilty of committing a burglary even if nothing is stolen as long as the defendant had an intent to commit a misdemeanor. Burglary is often an offense that is committed along with other serious offenses, such as arson, criminal damage to property, or violence against individuals.
